Course Description:
This course introduces one to the practical world of notice and comment rulemaking, otherwise know as "informal rulemaking", under the Administrative Procedure Act. It will reveal who the key players are in this process, both inside and outside of government, and explore why some are routinely successful and others far less so. Course participants will have ample opportunity to "play" in live, on-going rulemakings, collaborate with their course colleagues on comments for the rulemaking docket and ultimately be judged/graded on the quality of their oral as well as written presentations. This is a writing course.

Course Description:
The seminar will explore legal aspects of the new American strategy to prosecute the domestic war on terrorism, as well as related policies and politics. Defining terrorism and efforts to deal with it before the attacks of September 11 set the context. Executive actions include military tribunals, the national strategies on security and the draft strategy to secure cyberspace. Legislation includes the Homeland Security Act of 2002 and the USA PATRIOT Act. Cases include constitutional and statutory issues involving enemy combatants, electronic surveillance, material witnesses, immigrants, sleeper cells and nonprofit organizations. The Congressional resolution authorizing use of military force against Iraq and U.N. Security Council Resolution 1441 will be touched on. Guests have included the former Director of Central Intelligence and the Arlington Chief of Police.
