General Description: This class will study the Bilski case and the return of patentable subject matter jurisprudence since its denouement in the Federal Circuit’s 1998 decision in State Street Bank. The course will be split between studying the patentable subject matter case law and the details of the Bilski case. Ultimately, the purpose of this class is to understand whence the Bilski case arose, why the Supreme Court granted cert in this case, and what is the longstanding, albeit neglected, case law on patentable subject matter that the Court will use to decide Bilski.
