Malcolm Participates in Online Colloquy

Professor Joyce Lee Malcolm participated in an October 27 Northwestern University Law Review online colloquy entitled "Mc Donald v. Chicago: Which Standard of Scrutiny Should Apply to Gun-Control Laws?"

Malcolm is joined in the debate by Professor Lawrence Rosenthal of Chapman University School of Law as the two debate the standard of scrutiny that the Supreme Court should apply to restrictions on the Second Amendment in the wake of its recent decision in McDonald v. City of Chicago. Rosenthal begins Part I by considering a lower standard of scrutiny necessary to allow law enforcement officials to protect the community. Citing the practical consequences of the Chicago and Washington, D.C., recent gun-control laws, which make owning a gun nearly impossible in those cities, Malcolm argues for a standard of strict scrutiny for all gun-control laws in Part II. Rosenthal replies in Part III.
