Mossoff Discusses Patent Case in SCOTUScast

In a post-decision SCOTUScast sponsored by the Federalist Society, Professor Adam Mossoff discusses the March 20 Supreme Court decision in Mayo Collaborative Services v. Prometheus Laboratories, Inc.

Central to the case was the question of whether a patent can be issued for an observed correlation between blood test results and patient reactions to prescription drugs. In an opinion delivered by Justice Breyer, the Court unanimously held that such a patent effectively attempts to claim underlying laws of nature, and is therefore invalid.
