Somin Blog Post Selected by The Green Bag as One of Year's Best

Professor Ilya Somin's blog post on upholding the recent health law's individual mandate was singled out as one of the top legal blog posts of 2012 by the Green Bag's Journal of Law. The original post appeared in The Volokh Conspiracy on May 21, 2012, entitled "Nonlegal Arguments for Upholding the Individual Mandate." In it Somin cites a number of nonlegal reasons used to support the idea that the Supreme Court should uphold the law, beyond those legal reasons embraced by either side in the debate, and concludes that the case should not be decided based on nonlegal considerations.

"It is more important that its decision be right than that it be perceived as legitimate, nonpartisan, or conservative," says Somin.
