Zywicki Files Amicus Brief in Behalf of Monks in Casket Case

Professor Todd Zywicki has filed an amicus brief in support of the monks of St. Joseph's Abbey near Covington, Louisiana, who have sought the right to sell cypress caskets made in their workshop without paying fees and meeting requirements to obtain certification from the Louisiana Board of Embalmers and Funeral Directors. 

Federal appellate judges in New Orleans will hear arguments in June in the appeal of a district court decision in favor of the monks that overturned the Louisiana law permitting only licensed funeral directors to sell coffins. A judge found in that case that the state statute unfairly shielded a funeral industry monopoly to the detriment of consumers.

The Federal Trade Commission filed an amicus brief stating it "consistently has opposed laws that prohibit persons other than licensed funeral directors from selling caskets or urns."
