Krauss on “Pain and Suffering” Damages

In his column on Forbes, Professor Michael Krauss discusses caps on “pain and suffering” damages. He writes, “A cap is better than no cap, and a general cap is more compatible with the Rule of Law than one limited to med-mal, I think – it is hard for me to see why a drunken driver who breaks my leg with his car should owe me more money than a drunken physician who breaks my leg with his forceps.”
