Somin on Eminent Domain and Foreclosure

In an article in the ABA Journal, Professor Ilya Somin comments on constitutional issues with the Richmond CARES plan. The plan involves the California city’s use of eminent domain to help homeowners keep their homes and avoid foreclosure. The constitutional issues that Somin sees are related to just compensation under the Fifth Amendment and to the Commerce Clause.
